Summon Inc., doing business as Fleet Monster (“Fleet Monster,” “Company,” “we,” “us,” or “our”), provides a cloud-based software-as-a-service platform designed to support garage, valet, parking, detailing, and vehicle service businesses in managing work orders, operational workflows, and customer communications (the “Services”).

In this context, the Operator is the data controller and determines the purposes and means of processing personal information. Fleet Monster processes personal information only pursuant to the Operator’s instructions and does not determine the content, timing, recipients, or legal basis for communications sent to end customers.
Fleet Monster has no independent relationship with the end customers of Operators and does not use such information for its own commercial purposes.
1.2 Fleet Monster as Data Controller
Fleet Monster acts as a data controller with respect to personal information collected for its own business purposes, including information relating to Operator account owners and authorized users, billing and subscription administration, sales, onboarding, customer support, website visitors, compliance, security, and fraud prevention.

2.1 Personal Information Processed on Behalf of Operators
Depending on how an Operator configures and uses the Services, Fleet Monster may process personal information on the Operator's behalf, including:

- Communications content generated by Operator workflows
Fleet Monster processes this information solely to provide the Services and strictly in accordance with the Operator’s instructions.
2.2 Personal Information Collected Directly by Fleet Monster
Fleet Monster may collect personal information directly from individuals interacting with the Company, including:
- Names
- Business names
- Job titles
- Email addresses
- Phone numbers
- Account credentials
- Billing information
- Subscription details
- Payment metadata processed by third-party processors

- Operators and their authorized users
- End customers of Operators via Operator-entered data

5.1 Communications Sent on Behalf of Operators
The Services enable Operators to send transactional communications to their customers, including:

- Vehicle readiness notifications
- Pickup instructions
- Appointment confirmations
- Transactional receipts
These communications are triggered by Operator activity or configuration, sent according to Operator-defined workflows, delivered using third-party messaging providers including Twilio, and sent solely on behalf of the Operator.
Operators are solely responsible for ensuring compliance with all applicable laws governing such communications.
5.2 Communications Sent by Fleet Monster
Fleet Monster may send communications directly to Operators for business-related purposes, including:
- Account administration
- Billing notices
- Security alerts
- Service updates
- Legal notifications
6. SMS, Email, and Messaging Compliance
Fleet Monster does not independently collect or verify consent from end customers for SMS or email communications sent on behalf of Operators.
Operators represent and warrant that they have obtained all legally required consents, permissions, and authorizations prior to initiating communications through the Services, including under:
- The Telephone Consumer Protection Act (TCPA)
- The CAN-SPAM Act
- Applicable state laws
Fleet Monster reserves the right to monitor messaging usage and to suspend, restrict, or terminate messaging capabilities if misuse, spam, or non-compliance is reasonably suspected.
7. Disclosure of Personal Information
Fleet Monster may disclose personal information:
- To service providers and sub-processors that perform services on our behalf
- To comply with legal obligations
- To protect the rights, safety, or property of Fleet Monster or others

Fleet Monster does not sell personal information.

End customers of Operators should direct any requests regarding their personal information to the relevant Operator. Individuals who interact directly with Fleet Monster may request access, correction, or deletion of personal information controlled by Fleet Monster, subject to applicable law.

The Services are not intended for individuals under 18 years of age. Fleet Monster does not knowingly collect personal information from children.
14. Changes to This Privacy Policy
Fleet Monster may update this Privacy Policy from time to time. Updates will be posted on the website with a revised effective date.
Continued use of the Services after changes become effective constitutes acceptance of the revised policy.
